What BloomFi does. BloomFi develops and operates the BloomFi website, app, blockchain network and related software (the "Platform"). Through the Platform, BloomFi gives you access to financial services provided by licensed third-party providers ("Partners"), and provides technical support and technology infrastructure to those Partners, including the payment service provider GetOn.
What BloomFi does not do. BloomFi does not itself hold your money, issue cards, open bank or payment accounts, transmit money, or exchange or hold crypto-assets on your behalf. Each of those services is provided by the Partner that is licensed or registered to provide it. The Partner for a particular service will be disclosed to you, with its regulatory status and its own terms, before you request that service. Your contract for that service is with that Partner.
By creating a BloomFi account, clicking "I agree", or using the Platform, you confirm that you have read, understood and accepted these Terms, the BloomFi Privacy Policy, the BloomFi Cookie Policy and the Fee Schedule. If you do not agree, do not use the Platform.
1. Definitions
1.1 In these Terms:
- "AML Laws" means the anti-money laundering, counter-terrorist financing, proliferation financing and sanctions laws that apply to BloomFi or to a Partner, including UAE Federal Decree-Law No. 10 of 2025, and the AML laws of each Partner's home jurisdiction.
- "BloomFi Account" means your profile on the Platform, through which you access the Platform and request Partner Services.
- "Business User" means a User that is a legal entity, partnership, sole trader or other person acting for purposes relating to its trade, business or profession.
- "Consumer" means an individual acting for purposes outside their trade, business, craft or profession.
- "Digital Asset" means a crypto-asset or virtual asset, including a stablecoin, that is supported on the Platform from time to time.
- "Fee Schedule" means the schedule of BloomFi fees, and of Partner fees shown on the Platform, as published on the website and in the app and amended from time to time.
- "KYC/KYB" means the identification, verification and due diligence on the User and, for Business Users, its directors, authorised signatories, beneficial owners (25% or more) and controlling persons, as required by AML Laws, a Partner or BloomFi's policies.
- "Onboarding" means the process from registration until we confirm that KYC/KYB has been successfully completed and your BloomFi Account is activated for one or more Partner Services.
- "Partner" means a bank, payment institution, electronic money institution, money services business, card issuer, crypto-asset or virtual asset service provider, custodian, liquidity provider, identity-verification provider or other third party that provides a service to you through the Platform, or helps us provide the Platform.
- "Partner Service" means a regulated or financial service provided to you by a Partner through the Platform, such as an account, payment, card, currency exchange or Digital Asset service.
- "Partner Terms" means the terms and conditions, privacy notice and other documents of the Partner that provides a Partner Service.
- "Platform" means the BloomFi website (bloomfi.xyz), the BloomFi app, the BloomFi blockchain network, wallet software, application programming interfaces and related software and content operated by BloomFi.
- "Self-Custody Wallet" means wallet software provided through the Platform in which only you hold or control the private keys or credentials that authorise transactions.
- "Set-up Fee" means the one-off onboarding fee, if any, stated in the Fee Schedule.
- "Business Day" means a day other than a Saturday, Sunday or public holiday in the United Arab Emirates.
1.2 Headings are for convenience only. "Including" means "including without limitation". A reference to a law includes that law as amended or replaced.
1.3 If there is a conflict between these Terms and the Partner Terms for a Partner Service, the Partner Terms prevail for that Partner Service, except for Parts 4, 6, 8 and 10 of these Terms, which always apply to your use of the Platform.
2. Our role and the Partners
2.1 BloomFi is a technology provider. BloomFi provides the Platform and technical support. BloomFi is not a bank, payment institution, electronic money institution, money services business, card issuer or virtual asset service provider, and does not hold a licence to provide financial services. Funds and Digital Assets connected with Partner Services are not deposits and are not covered by any deposit insurance or compensation scheme, unless the Partner that holds them states otherwise in its Partner Terms.
2.2 Partners provide the regulated services. Each Partner Service is provided by a Partner that is licensed, registered or otherwise authorised to provide it where you are. We will disclose which Partner provides a particular service, its legal name, its regulator and registration details, and its Partner Terms, before you request that service. The Partner may differ depending on the service, your country of residence, the currency and whether you are a Consumer or a Business User. The Partner for each active service is shown in your BloomFi Account at all times.
2.3 Your contract for a Partner Service is with the Partner. By requesting a Partner Service you enter into a separate agreement with that Partner on its Partner Terms. The Partner, not BloomFi, is responsible to you for providing that service, including holding and safeguarding your funds or Digital Assets, executing your payments, and handling complaints about that service under its own procedures. BloomFi is responsible to you for the Platform under these Terms.
2.4 BloomFi acts for Partners. To deliver Partner Services through the Platform, BloomFi provides technology infrastructure and technical support to Partners. Where we collect information, carry out identity checks or pass your instructions to a Partner, we do so on that Partner's behalf and under its instructions and supervision. We do not act as agent of a Partner for the purpose of providing regulated services unless the Partner Terms say so.
2.5 Self-Custody Wallets. Where the Platform provides a Self-Custody Wallet, only you control the private keys or credentials. BloomFi cannot access, move, freeze or recover Digital Assets in a Self-Custody Wallet, and cannot reverse a transaction you authorise. If you lose your keys or credentials, you may permanently lose your Digital Assets. Where a Digital Asset service is custodial (a Partner holds Digital Assets for you), it is a Partner Service provided under the Partner Terms.
2.6 Products not offered under these Terms. Trading, derivatives (including perpetual contracts), lending, staking, yield, "earn" and vault products are not offered under these Terms. If any of them is made available on the Platform, it will be provided by a Partner licensed to provide it, under separate terms, and only where permitted by law.
2.7 Availability. Not all Partner Services, currencies, Digital Assets or features are available to all Users or in all jurisdictions. A Partner may decide not to provide a service to you. We are not obliged to make any Partner Service available.
2.8 No advice. Neither BloomFi nor the Platform provides investment, tax, legal or financial advice. Any information we provide is general only.
3. Eligibility and cross-border access
3.1 Who may register. You may create a BloomFi Account if you are:
- an individual of at least 18 years of age (or the age of majority where you live, if higher) with full legal capacity; or
- a legal entity or other organisation duly incorporated or registered and in good standing, acting through a duly authorised representative.
3.2 Restricted jurisdictions and activities. The Platform and Partner Services are not available to persons who are resident, incorporated, located or operating in, or whose beneficial owners are nationals or residents of, a jurisdiction on our or a Partner's list of prohibited jurisdictions, or who carry on an activity on our or a Partner's list of prohibited businesses. These lists may change without notice. They are not available to persons designated under UAE, UN, UK, EU, US or Canadian sanctions, or owned or controlled by such persons.
3.3 Where Partner Services are available. A Partner Service is available only in the countries where the Partner providing it is permitted to provide it. The countries in which each Partner Service is available are shown in the Platform before you request it.
3.4 No solicitation where we or the Partner are not authorised. Nothing on the Platform is an offer of, or invitation to use, a Partner Service in any jurisdiction where that offer would be unlawful or where the Partner is not authorised to provide it. If you are established, resident or located in the European Union, the European Economic Area or the United Kingdom, Partner Services are provided only where you approached BloomFi or the Partner on your own exclusive initiative, and you will not benefit from the protections that apply to clients of firms authorised in your country, except for protections that cannot be excluded by contract (Part 10).
3.5 United Arab Emirates. Partner Services involving virtual assets are not offered to persons in the United Arab Emirates unless the Partner providing them holds the required UAE licence, which will be disclosed in the Platform.
3.6 Your responsibility for local law. You are responsible for ensuring that using the Platform and any Partner Service is lawful where you are located or established. We may refuse or end access where we reasonably believe that providing it would breach any law that applies to us or a Partner.
3.7 One account. Unless we agree otherwise, you may hold one BloomFi Account only. You must use it only for yourself (Consumers) or for the business disclosed during KYB (Business Users), and never for or on behalf of any undisclosed third party.
4. Onboarding, KYC/KYB and the Set-up Fee
4.1 No transactions before KYC/KYB. You may not use any Partner Service until Onboarding for that service is complete and the Partner has accepted you. Funds or Digital Assets received before activation may be held, returned to source or otherwise dealt with as AML Laws require.
4.2 Information we will request. To meet the requirements of AML Laws and of our Partners, we, the Partner or an identity-verification provider acting for us or the Partner will request information and documents, which may include:
- for individuals: full name, date of birth, address, occupation, nationality, government-issued photo ID, a live selfie or video for biometric and liveness verification, tax residence, source of funds and source of wealth;
- for Business Users: certificate of incorporation, articles, registers of directors and shareholders, proof of address, licences, ownership and control structure, beneficial owners holding 25% or more, directors and authorised signatories (each verified as an individual), nature of business, expected activity, counterparties and source of funds;
- PEP (politically exposed person), head of international organisation, family member and close associate status, and third-party determination;
- for Digital Asset services: details and proof of ownership or control of each external wallet.
4.3 Identity-verification providers and sharing with Partners. We use an identity-verification provider to verify your identity, check documents, perform biometric and liveness checks, check business registries and screen against sanctions, PEP and adverse-media sources. Biometric data is used only for identity verification and fraud prevention. We share your KYC/KYB information with the Partner that provides the service you request, so that it can carry out its own due diligence, and, where you request services from more than one Partner, we may share it through the provider's secure sharing function so that you do not have to verify again. The provider used for your verification will be disclosed to you before you start. See the BloomFi Privacy Policy.
4.4 Accuracy. All information you provide must be true, complete, current and not misleading. You must tell us within 10 Business Days of any change, including changes in address, control, ownership, directors, business activity or PEP status.
4.5 Decisions. We or the Partner may accept or decline any application at our or its sole discretion and are not required to give reasons, in particular where giving reasons would breach AML Laws.
4.6 Refusal to complete KYC/KYB. If you refuse to provide information or documents requested, or refuse to take part in any verification step, this is a material breach of these Terms. We may decline your application or immediately terminate the business relationship and close your BloomFi Account.
4.7 Abandonment. If you start Onboarding but do not provide the requested information or complete a requested step within 30 calendar days of the request (including after one reminder sent to your registered e-mail), you will be treated as having refused to complete KYC/KYB, with the consequences in clauses 4.6 and 4.9.
4.8 Ongoing due diligence. KYC/KYB is not a one-time event. We or a Partner may at any time ask you to refresh or add to your information, explain a transaction, or provide evidence of source of funds, source of wealth or the purpose of a transaction. You must respond within the time reasonably set (normally 10 Business Days, or less where AML Laws or a Partner require).
4.9 Set-up Fee. If a Set-up Fee applies, it covers the cost of the onboarding assessment, including third-party KYC/KYB checks and compliance review, and is payable when you apply. The Set-up Fee is non-refundable where:
- you refuse to complete KYC/KYB (clause 4.6);
- you abandon Onboarding (clause 4.7);
- the relationship is terminated because you refuse or fail to cooperate on AML, compliance or legal matters (clause 6.4); or
- your application is declined because you provided false, incomplete or misleading information.
Where an application is declined for any other reason, the Set-up Fee will be refunded less the documented cost of third-party checks to the source from which it was paid. Nothing in this clause limits any refund right you have under mandatory consumer law (Part 10).
4.10 Cooling-off. Where mandatory law gives a Consumer a right to cancel a distance contract within a set period, that right applies. If you ask us to start Onboarding within that period, you agree that the Set-up Fee covers services already performed and may be retained to that extent, as permitted by applicable law.
5. Partner Services through the Platform
5.1 Disclosure before you request a service. Before you request any Partner Service, the Platform will show you: the Partner's legal name, its country, its regulator and licence or registration number; the Partner Terms; the fees; and the countries in which the service is available. You must accept the Partner Terms before using the service.
5.2 Accounts and payments. Accounts, account identifiers (such as IBANs or local account numbers), payment execution and currency exchange are provided by a licensed bank, payment or electronic money institution or money services business, as disclosed under clause 5.1. That Partner holds and safeguards your funds under its own regulatory regime. Execution times, cut-off times, limits and refund rights are set out in the Partner Terms.
5.3 Cards. Payment cards are issued by a licensed card issuer that is a member of a card scheme, as disclosed under clause 5.1. The card remains the property of the card issuer and is governed by its card terms. How a card is funded (for example from a fiat balance or a stablecoin balance) is explained in the Platform and the card terms before you order a card.
5.4 Digital Asset services. Exchanging between fiat currency and Digital Assets, exchanging between Digital Assets, and holding Digital Assets on your behalf are provided by a Partner authorised to provide them where you are, as disclosed under clause 5.1. Where you use a Self-Custody Wallet, clause 2.5 applies.
5.5 Digital Asset risk warning. By using any Digital Asset feature of the Platform you confirm you understand that:
- Digital Asset prices can be highly volatile and you may lose all of their value;
- stablecoins aim to keep a stable value against a currency, but can lose that link (de-peg) temporarily or permanently, and depend on their issuer's reserves and ability to redeem them;
- Digital Assets are not legal tender and are not protected by any deposit insurance or compensation scheme;
- blockchain transactions are irreversible, and errors (such as a wrong address or network) can result in permanent loss;
- networks, including the BloomFi network, may be affected by outages, forks, smart-contract failures, cyber-attacks and regulatory changes;
- you are responsible for any tax arising from your Digital Asset transactions.
5.6 Passing on your instructions. When you give an instruction for a Partner Service through the Platform, we pass it to the Partner, which decides whether and how to execute it under its Partner Terms. We are responsible for passing on your instructions accurately and promptly; the Partner is responsible for executing them.
5.7 Change of Partner. We may change the Partner for a service. We will give you at least 30 days' notice, disclose the new Partner under clause 5.1, and ask you to accept its Partner Terms, unless the change is required urgently by law or a regulator, in which case we will give as much notice as we can. If you do not accept the new Partner, you may stop using that service free of charge.
6. AML, counter-terrorist financing and sanctions
6.1 Obligations of Partners and BloomFi. Partners are subject to AML Laws and must identify their customers, monitor transactions, keep records and report suspicious activity to the competent authorities. BloomFi supports Partners in meeting these obligations, and complies with the AML and sanctions laws that apply to BloomFi itself.
6.2 Sanctions. You must not use the Platform or any Partner Service, directly or indirectly, for the benefit of, or to deal with, any person or territory subject to sanctions under UAE law, United Nations measures, or the sanctions regimes of the United Kingdom, the European Union, the United States or Canada, where those regimes apply to us or a Partner.
6.3 Holds, freezes and no tipping-off. We or a Partner may suspend your BloomFi Account, hold or delay a transaction, or freeze funds or Digital Assets held by a Partner, where required by law, a competent authority or a court, or where there is a reasonable suspicion of a breach of AML Laws or these Terms. The law may prohibit us or the Partner from telling you that a report has been made or a request received, or the reasons for a hold or closure. In those cases no reasons will be given, and we will not be liable for not giving them.
6.4 Duty to cooperate. You must cooperate fully, promptly and in good faith with all requests we or a Partner make in connection with AML, compliance, sanctions, fraud prevention, regulatory, audit or legal matters, including requests for information, documents, explanations, video calls or meetings. Refusal or failure to cooperate (including not responding within the time set under clause 4.8, giving evasive or misleading responses, or withdrawing consent needed for checks required by law) is a material breach. It may lead to suspension and termination of the business relationship, and in that case the Set-up Fee is not refundable.
6.5 Your warranties. You confirm, and confirm again each time you use the Platform, that: the funds and Digital Assets you use are from lawful sources; you act on your own behalf (or, for Business Users, on behalf of the disclosed business); you are not a sanctioned person or acting for one; and all information you have given is accurate and complete.
6.6 Third-party determination. If you act on behalf of, or under instructions from, a third party, you must tell us before the first transaction and provide information about that third party as requested.
7. Fees, security and prohibited use
7.1 Fees. You agree to pay the BloomFi fees in the Fee Schedule (for example the Set-up Fee and any Platform subscription fee) and the Partner fees set out in the Partner Terms. Before you confirm a transaction, the Platform will show you the applicable fees, exchange rate and total amount, or how they are calculated. Blockchain network fees are set by the network, not by us.
7.2 Changes to fees. We will give you at least 30 days' notice of any increase in BloomFi fees or any new BloomFi fee, unless a change is required by law and shorter notice is necessary. Changes to Partner fees are governed by the Partner Terms.
7.3 Taxes. Fees are stated exclusive of any applicable taxes, such as value added tax, which will be added where required. You are responsible for your own taxes.
7.4 Your security duties. You must keep your login details, passwords, one-time codes, devices, PINs, card details, private keys and recovery phrases safe; enable two-factor authentication; not allow anyone else to use your BloomFi Account; and log out of shared devices. BloomFi will never ask you for your full password, your PIN, a private key or a recovery phrase.
7.5 Unauthorised or incorrect transactions. You must tell us without undue delay, through in-app support or at support@bloomfi.xyz, if you believe your credentials have been compromised or a transaction was unauthorised or incorrect. We will pass the report to the relevant Partner immediately. Your rights to a refund for an unauthorised or incorrectly executed payment or card transaction are set out in the Partner Terms. Transactions from a Self-Custody Wallet that you authorised cannot be reversed.
7.6 Prohibited use. You must not use the Platform or any Partner Service:
- for money laundering, terrorist financing, proliferation financing, sanctions evasion, fraud, tax evasion, bribery or any other crime;
- for any activity on our or a Partner's prohibited businesses list, including unlicensed gambling, unlicensed financial services, shell banks, weapons, illegal adult content and darknet trading;
- to receive or send funds or Digital Assets on behalf of undisclosed third parties, or to provide payment or exchange services to others (nesting) without prior written consent;
- to structure transactions to avoid reporting thresholds or limits;
- to interfere with, reverse-engineer, attack or overload the Platform or the BloomFi network, exploit any bug or vulnerability, or access the Platform by automated means we have not approved;
- in breach of the rules of a card scheme, payment scheme or Partner.
7.7 Business Users must hold all licences required for their activities, keep us informed of changes in their business model, and ensure their users, employees and cardholders comply with these Terms.
7.8 Responsible disclosure. If you find a security vulnerability in the Platform, report it to compliance@bloomfi.xyz and do not exploit or disclose it publicly.
8. Data protection, intellectual property and the Platform
8.1 Data protection. BloomFi processes your personal information as described in the BloomFi Privacy Policy, which forms part of these Terms. In short:
- BloomFi is the controller of personal information it processes to run the Platform and your BloomFi Account;
- when BloomFi processes personal information to provide a Partner Service (for example as technology provider to GetOn), it does so as that Partner's processor, only on the Partner's instructions, and the Partner's privacy notice also applies;
- each Partner is an independent controller of the personal information it receives to provide its Partner Service;
- we, and Partners, keep KYC/KYB and transaction records for at least five years from the end of the business relationship, or longer where the law or an authority requires;
- we do not sell your personal information.
You can contact us about privacy at compliance@bloomfi.xyz.
8.2 Intellectual property. The BloomFi name and brand, the Platform, the BloomFi network software and all related content belong to BloomFi or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose only. Open-source software included in the Platform is governed by its own licence.
8.3 Availability of the Platform. We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may suspend the Platform, or any feature, for maintenance, upgrades, security reasons or where a Partner or network is unavailable. We will give advance notice of planned maintenance where we reasonably can.
8.4 Changes to the Platform. We may change, add or remove features of the Platform. If a change materially reduces a feature you rely on, we will give you reasonable notice.
8.5 Test and pre-release features. Features marked as test, beta or pre-release (including any test network) are provided "as is", may not work as expected and must not be used with real funds or Digital Assets unless we say otherwise.
8.6 Third-party services. The Platform may link to or integrate third-party services, including external wallets and blockchain networks. We are not responsible for third-party services that are not Partner Services.
9. Suspension, termination, liability and complaints
9.1 Termination by you. You may close your BloomFi Account at any time through the app or by contacting support, subject to completing pending transactions and any compliance review. Closing your BloomFi Account ends your access to Partner Services through the Platform; the Partner Terms explain how each Partner Service ends and how your funds or Digital Assets are returned.
9.2 Termination by us on notice. We may terminate these Terms by giving you at least 60 days' notice (Consumers) or 30 days' notice (Business Users).
9.3 Immediate suspension or termination. We may suspend or terminate your access to the Platform immediately, with or without notice and without giving reasons where the law prevents it, if:
- you refuse, abandon or fail to complete KYC/KYB (Part 4);
- you refuse or fail to cooperate on AML, compliance, sanctions or legal matters (clause 6.4);
- you commit a material or repeated breach of these Terms;
- we or a Partner suspect fraud, money laundering, terrorist financing, sanctions breaches or other illegal activity;
- you become a sanctioned person, or move to or start operating in a prohibited jurisdiction;
- you provided false, incomplete or misleading information;
- a Partner requires it or stops providing a service to you;
- we are required to by law, a regulator, a court or another competent authority; or
- continuing the relationship would expose us or a Partner to legal, regulatory or reputational risk beyond our risk appetite.
9.4 Consequences. On termination, you must pay all amounts owed to us. Funds and Digital Assets held by a Partner are returned by that Partner under its Partner Terms, subject to any hold required by law. Digital Assets in a Self-Custody Wallet remain under your control; you should make sure you hold your keys or recovery phrase before your access ends. The Set-up Fee is not refundable on termination for any of the reasons in clauses 9.3(1), 9.3(2) or 9.3(6).
9.5 Survival. Parts 6, 8, 9 and 10, and any accrued rights and obligations, survive termination.
9.6 Our liability. We are responsible for providing the Platform with reasonable care and skill. To the extent permitted by law, we are not liable for:
- the acts or omissions of a Partner in providing a Partner Service, which are the Partner's responsibility under its Partner Terms;
- loss caused by your breach of these Terms, your negligence, or incorrect information or instructions you provide;
- loss of Digital Assets in a Self-Custody Wallet caused by loss or disclosure of your keys or recovery phrase, or by a transaction you authorised;
- loss caused by our compliance with AML Laws, sanctions, a court order or a regulator's direction;
- changes in the market value of Digital Assets or currencies, including a stablecoin de-peg, or failures of blockchain networks we do not control;
- indirect or consequential loss, loss of profit, business, goodwill, opportunity or data.
9.7 Cap. Except as stated in clause 9.8, our total liability to a Business User arising out of or in connection with these Terms in any 12-month period is limited to the BloomFi fees paid in the 12 months before the event giving rise to the claim.
9.8 What we do not exclude. Nothing in these Terms limits or excludes our liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be limited or excluded by law. For Consumers, clauses 9.6 and 9.7 apply only to the extent permitted by applicable consumer protection law.
9.9 Indemnity. Business Users indemnify us against losses, fines, penalties and reasonable legal costs arising from their breach of these Terms or of law. Consumers are liable for such losses only to the extent permitted by applicable consumer protection law.
9.10 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government action, sanctions, failures of Partners, payment or card schemes or blockchain networks, cyber-attacks despite reasonable security measures, or power or telecommunications failures.
9.11 Complaints. Complaints about the Platform should be raised through in-app support or at support@bloomfi.xyz. We will acknowledge your complaint within 3 Business Days and send a final response within 15 Business Days, or explain why we need more time and respond within 35 Business Days. Complaints about a Partner Service are handled by the Partner under its complaints procedure; if you send one to us, we will pass it to the Partner within 1 Business Day and tell you we have done so.
10. Governing law, your mandatory rights and general provisions
10.1 Governing law. These Terms, and any dispute or claim (including non-contractual disputes) arising out of or in connection with them, are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates applicable in Dubai. Partner Terms are governed by the law stated in them.
10.2 Jurisdiction. The courts of Dubai have jurisdiction to settle any dispute. For Business Users this jurisdiction is exclusive.
10.3 Your mandatory rights are preserved. Nothing in these Terms deprives you of the protection of any provision of the law of the country in which you habitually reside that cannot be excluded or limited by agreement, including any right of a Consumer to bring proceedings in the courts of their country of residence where that law allows it.
10.4 Voluntary departure from domestic protections. Where a protection under your domestic law can lawfully be waived or excluded by agreement, and you choose on your own initiative to use the Platform (operated by a UAE company) and Partner Services from Partners not authorised in your jurisdiction, you accept that you will not benefit from regulatory protections that apply only to clients of firms authorised there (for example local ombudsman schemes or deposit or investor compensation schemes), as described in clauses 2.1 and 3.4. You confirm that you have accepted these risks voluntarily. This clause does not affect any right that cannot be waived by law.
10.5 Language. These Terms are concluded in English, and you confirm that you have chosen to contract in English and understand it. Where a mandatory law of your country of residence requires these Terms or any information to be given to you in a local language, we will provide a translation on request, and that version prevails to the extent the mandatory law requires.
10.6 Changes to these Terms. We may change these Terms by giving you at least 60 days' (Consumers) or 30 days' (Business Users) notice by e-mail or in the app. If you do not agree, you may close your BloomFi Account free of charge before the change takes effect. If you do not object, you are treated as having accepted the change. We may make changes immediately where required by law or a regulator, or where the change is in your favour.
10.7 Communications. We communicate with you in English by e-mail, in the app or on the website. You agree to receive these Terms, notices and disclosures electronically, and must keep your contact details up to date.
10.8 Assignment and subcontracting. You may not transfer your rights or obligations without our written consent. We may transfer our rights and obligations to a group company or a successor on 30 days' notice, provided your rights are not reduced. We may use subcontractors but remain responsible to you for the Platform.
10.9 Entire agreement, severability and waiver. These Terms, the Fee Schedule, the BloomFi Privacy Policy and the BloomFi Cookie Policy are the entire agreement between you and BloomFi about the Platform. If any provision is invalid, the rest remain in force. A delay in exercising a right is not a waiver of it.
10.10 Third-party rights. No person other than you and BloomFi has any right to enforce these Terms, except Partners where expressly stated.
